Do you have to file a zero PIT return with no sales in Poland?
An active sole proprietorship in Poland generally requires filing an annual tax return even if no sales occurred during the year. Depending on your tax structure, a zero PIT-36, PIT-36L or PIT-28 for 2026 must be submitted by 30 April 2027.

You run a one-person company in Poland (a JDG, or sole proprietorship), but in 2026 you did not issue a single invoice. Clients went quiet, a project slipped, or you simply paused the business. Now you wonder whether you still have to file a zero PIT by 30 April 2027.
The short answer: if the business was active, usually yes. No sales does not close your source of business income. There are exceptions, but they are narrower than most people assume, and a missed filing can cost more than the few minutes it takes to submit one.
Below: when a zero return is mandatory, when it is not, and which other obligations survive a revenue-free year. I write as a software founder who builds invoicing tools, not as an accountant. This is not tax advice, only an organised summary of official positions and commentary, with links.
When a zero PIT is mandatory
The obligation depends on whether you have an "open" source of income, meaning a registered business activity. The Ministry of Finance has answered this directly: if you earned nothing from your business because it was suspended or had no turnover, you still have to report a value of "0" in your return (as reported by pit.pl). General rules and forms are on podatki.gov.pl (Polish only).
Which form you use depends on how your business is taxed:
Taxation method | Form | What you enter with no sales |
|---|---|---|
Progressive scale (12% / 32%) | PIT-36 (with PIT/B appendix) | 0 PLN revenue, plus any costs |
Flat tax 19% | PIT-36L (with PIT/B appendix) | 0 PLN revenue, plus any costs |
Lump-sum on recorded revenue (ryczałt) | PIT-28 | 0 PLN revenue |
The deadline for all three forms for tax year 2026 is 30 April 2027. If the last day of April falls on a non-working day, it moves to the next working day.
One trap catches many people: PIT-36, PIT-36L and PIT-28 are not auto-approved in the Twój e-PIT service. If you do nothing, nothing is filed.
Does a suspended business exempt you from PIT?
Sources disagree here, so it helps to separate two cases.
Suspended for the entire year, no revenue, no costs. Some publications say no return is required in that case (e-pity.pl, podatnik.info, both in Polish). Others, and the Ministry answer cited above, take the cautious line: the obligation stays because the business still formally exists.
Suspended for part of the year. No debate. If there was revenue or cost before the suspension, you file and report the whole year.
Because the rules leave room for dispute, a practical approach is: when in doubt, file the zero return. It takes minutes, and an unnecessary filing does no harm, while a missing one can.
Costs without revenue: filing is worth it
A year with no sales is rarely a year with no expenses. Hosting, software subscriptions, an accountant, social security contributions: depending on your tax form and the nature of the expense, these may be deductible costs.
On the progressive scale or flat tax, filing PIT-36 or PIT-36L with costs and zero revenue shows a tax loss, which you can carry forward against future income, but only if it is properly reported. Check the limits and the five-year window in the PIT Act on podatki.gov.pl. On ryczałt you do not deduct costs, so a zero PIT-28 is a pure formality.
PIT is not the whole story
No outgoing invoices does not switch off the rest of your obligations. The ones people forget most:
JPK_V7 (the VAT return and ledger file). An active VAT payer files it even for periods without transactions, as long as the filing obligation exists (overview of zero JPK_V7, Polish). If you are VAT-exempt and only make exempt supplies, you usually do not file it. Note that "no sales" does not automatically mean a zero file: purchase invoices and deductions still count.
ZUS (social security). While the business is active and you have no relief or suspension, declarations and contributions apply regardless of revenue. Check details on zus.pl.
KSeF (Poland's national e-invoicing system). Even if you issue nothing, supplier invoices may land in your KSeF inbox. The rollout rules and transition periods are described by the Ministry of Finance on gov.pl. Verify which deadlines and penalties apply to you before they take effect.
If you do not run a business and simply sold nothing
People without a company ask this too. The rule is simple: no taxable revenue means no obligation to file. PIT-38 (securities, crypto) and PIT-39 (real estate sales) are required only if a disposal actually happened. You may still file voluntarily, for example to reclaim advance tax withheld during the year.
Checklist: zero PIT in five steps
Check your tax form in CEIDG (the business register) and whether the business was active on at least one day in 2026.
Collect the year's costs, even with zero revenue (purchase invoices, contributions, fees).
Pick the form, PIT-36, PIT-36L or PIT-28, and file by 30 April 2027.
Check whether you owe JPK_V7 for months without sales (if you are an active VAT payer).
For doubts about suspension or losses, ask an accountant or request an individual tax interpretation.
Conclusion
A year without sales usually does not release you from PIT. If the business was active, you file a zero PIT-36, PIT-36L or PIT-28 by 30 April 2027. For a fully suspended year with no events at all, positions are less uniform, so filing is the safer path. Do not forget JPK_V7, ZUS and cost invoices that may still arrive through KSeF.

3. FAQ
Do I have to file a tax return in Poland if my business had no income? Usually yes, if the business was active. Sole proprietors file PIT-36, PIT-36L or PIT-28 with zero revenue. No sales does not close the income source. The deadline for 2026 is 30 April 2027.
Does suspending my business in Poland exempt me from PIT? Not always. If any revenue or costs occurred in the year, even before the suspension, you must file. For a full-year suspension with no events, opinions differ, so filing a zero return is safer.
Do I need a zero PIT-28 on lump-sum taxation? Yes, if the business operated during the year, even with no revenue. The zero PIT-28 tells the tax office there was no revenue. It has no cost section, so it takes only a few minutes.
Is a zero JPK_V7 required when I have no sales? For active VAT payers, generally yes, if anything affects the ledger, such as purchase invoices. VAT-exempt businesses making only exempt supplies usually do not file JPK_V7 at all.
What happens if I do not file a zero PIT? Missing the filing is a fiscal offence that can lead to a fine. You can file late together with a voluntary disclosure (czynny żal), which in some situations helps avoid a penalty.
